Terms of Service

Who we are

Tellbit is operated by VR BROS LLC, a company registered in the United Arab Emirates ("Tellbit", "we", "us" or "our"). By downloading, installing or using the Tellbit app for iPhone, iPad, Apple Watch or Android, or this website (together, the "service"), you agree to these terms. If you do not agree, please do not use the service.

The service

Tellbit lets you create short, ready-made messages ("Tellbits") and send them to people you have chosen to connect with, with a single tap. People connect with each other by scanning a QR code or opening an invite link. Tellbit is not a chat or social network, and there is no public profile, search or discovery.

The core service is free. Some features require a paid subscription or purchase, called Tellbit Plus (see "Tellbit Plus" below).

We may change, suspend or discontinue any part of the service at any time. We are not liable to you or anyone else for a change, suspension or discontinuation, except where the law says otherwise.

Eligibility

You must be at least 13 years old to use Tellbit. By using the service you confirm that you meet this requirement. If you are under 18, you confirm that your parent or guardian has given you permission. Tellbit is not directed at children under 13; as described in our Privacy Policy, a younger child should use it only on a parent's or guardian's account and under their supervision.

Your account

You create an account by entering a name. We do not ask for an email address, phone number or password. Instead your device holds a private credential that proves the account is yours. You may add a way to recover the account, such as Sign in with Apple on iPhone or Sign in with Google on Android, and you may use the same account on more than one device.

You are responsible for your devices, for keeping your recovery method secure, and for everything that happens under your account. If you lose all your devices and have not set up recovery, we may be unable to restore your account. Give us accurate information and keep it up to date. We may suspend or terminate accounts that break these terms or that we reasonably believe are being misused.

Connections and what you send

Tellbit lets you create and share content with the people you connect with ("User Content"): the names, icons, colors and collections of your Tellbits, your display name, your profile photo, the private nicknames you give people, and the Tellbits you send. You are responsible for your User Content and for choosing who you connect with and send to.

You keep ownership of your User Content. By creating or sending it, you give us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display it, for as long as it remains in your account, solely to operate the service, including delivering it to the people you chose.

We have zero tolerance for objectionable User Content or abusive behaviour of any kind. We may review, remove or hide any User Content, and suspend or terminate any account, at our discretion and without notice, including in response to a report. You can disconnect from or block anyone, mute a Tellbit or a person, and stop sharing a Tellbit at any time inside the app. To report abuse or content that concerns you, write to hello@vrbrosllc.com. We aim to act on reports promptly and we do not tell the person you reported who made the report.

Acceptable use

You agree not to:

• use the service for any unlawful purpose or in breach of any applicable law;
• send Tellbits or notifications to harass, threaten, bully, stalk, intimidate or target another person, or to send spam or unsolicited promotion;
• post or transmit anything unlawful, abusive, hateful, defamatory, sexually explicit, or that exploits or endangers a minor;
• post content that infringes someone else's intellectual property or privacy rights, or that you do not have the right to share;
• impersonate any person or entity or misrepresent your affiliation with anyone;
• attempt to gain unauthorised access to the service, other accounts or our infrastructure, or interfere with or disrupt its integrity or performance;
• use bots, scripts or other automated means to send, to create accounts or connections, or to get around rate limits or other protections;
• scrape, crawl or systematically extract content from the service, or reverse engineer, decompile or copy the app, except where the law gives you that right;
• circumvent or tamper with Tellbit Plus limits, purchase checks or any other technical restriction, or share a purchase in a way the service does not allow.

Notifications and reliability

Tellbit sends notifications through Apple, Google and other third-party networks. Delivery depends on your device, its settings and those networks, so a notification, a status such as "Seen" or "Got it", or a widget or watch update can be delayed, missing or out of date. Tellbit is not an emergency or safety service. Do not rely on it where a delayed or missed message could put anyone's safety, health or property at risk; contact the relevant emergency service directly instead.

Tellbit Plus

What it is. Tellbit is free to use with limits on, for example, how many active Tellbits and collections you can have. Tellbit Plus removes those limits and adds other features. The features and prices of each option are shown in the app before you buy, in your local currency and including any taxes the store adds. Features and limits may change over time.

Options. Plus is offered as an auto-renewing monthly subscription, an auto-renewing annual subscription, and a one-time "lifetime" purchase. A lifetime purchase is a single payment that gives you Tellbit Plus for as long as we offer Tellbit Plus and your account remains in good standing; it is not a promise for your lifetime or the lifetime of any device. Unless the app says otherwise at the time of purchase, there is no free trial.

Billing. Purchases are made through the Apple App Store or Google Play, and are processed by Apple or Google, not by us. We never see your payment details. Payment is charged to your Apple Account or Google account when you confirm the purchase.

Automatic renewal. Monthly and annual subscriptions renew automatically at the then-current price, for the same period, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the period. You can manage or cancel a subscription at any time in your App Store account settings (Settings, then your name, then Subscriptions) or in Google Play (Payments and subscriptions, then Subscriptions). Deleting the app or your Tellbit account does not cancel a subscription. If a price changes, the store will tell you and, where the law or the store requires it, ask for your consent before the new price applies.

Refunds. Apple or Google decides refund requests under their own policies, and we cannot issue refunds for store purchases ourselves. Nothing in these terms limits any right to a refund that the law gives you.

One account, both platforms. Tellbit Plus belongs to your Tellbit account, so a purchase on one platform unlocks Plus on the others where you use that same account. A single purchase can be linked to only one Tellbit account at a time.

If Plus ends. If a subscription ends or is refunded, your account returns to the free limits. We do not delete anything you have created, but you may not be able to add new items beyond the free limits until you subscribe again, and Plus-only features stop working.

Restoring purchases. You can restore a purchase from the Tellbit Plus screen on a new device signed in to the same store account.

Additional terms for iPhone, iPad and Apple Watch

If you get the app from the Apple App Store:

• These terms are between you and Tellbit only, not Apple. Tellbit, not Apple, is responsible for the app and its content, for providing maintenance and support, and for addressing claims about it. Apple has no obligation to provide maintenance or support.
• We grant you a limited, non-transferable licence to use the app on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• If the app fails to meet a warranty that applies, you may tell Apple, and Apple will refund the purchase price of the app to you, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the app. Other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility.
• We, not Apple, are responsible for any claims by you or a third party about the app or your possession and use of it, including product liability, legal or regulatory compliance, and consumer protection claims, and for any claim that the app infringes a third party's intellectual property. If such a claim is made, we, not Apple, are responsible for investigating, defending, settling and discharging it.
• You confirm that you are not in a country under a United States government embargo or designated as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when you use the app, such as your wireless data agreement.
• Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

Additional terms for Android

If you get the app from Google Play, your use of Google Play and of any purchase is also governed by the Google Play Terms of Service. These terms are between you and Tellbit, not Google. Tellbit is responsible for the app and for support; Google is not.

Content and intellectual property

Other than your User Content, everything in the service, including the app, its code, text, images, icons, sounds, the Tellbit name and logo, and the design of the service, is owned or controlled by VR BROS LLC or its licensors. We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your own private, non-commercial use, on the terms here. You may not copy, distribute, modify, sell, sublicense or create derivative works from any part of the service without our prior written permission.

If you send us feedback or ideas, we may use them without owing you anything.

Privacy

Your use of Tellbit is also governed by our Privacy Policy, which forms part of these terms. By using the service you consent to the data practices it describes.

Third-party services

The service relies on third parties such as Apple, Google, push notification networks, and our hosting and database providers. We are not responsible for their services, and their own terms and policies apply to your use of them.

Disclaimer of warranties

Tellbit is provided "as is" and "as available", without warranties of any kind, either express or implied, including any warranty of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free, that notifications or statuses will be delivered or accurate, or that it will be free of viruses or other harmful components. Some places do not allow certain exclusions, so some of this may not apply to you, and nothing here removes rights the law gives you that cannot be excluded.

Limitation of liability

To the fullest extent permitted by applicable law, VR BROS LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of, or inability to use, the service. Our total liability to you for any claim arising from these terms or your use of the service will not exceed the greater of AED 100 or the amount you have paid us in the twelve months before the claim arose. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law.

Termination

You may stop using Tellbit at any time. To delete your account and its data, open Tellbit, go to your profile, choose Account Settings, then Delete Account, and type DELETE to confirm; you can also email us at hello@vrbrosllc.com. Deleting your account does not cancel a store subscription; cancel that in the App Store or Google Play as described above.

We may suspend or terminate your access to the service at any time, with or without cause, and with or without notice. Terms that by their nature should survive termination will do so, including those on User Content licences, intellectual property, disclaimer of warranties and limitation of liability.

Changes to these terms

We may update these terms from time to time. When we do, we will change the date at the top of this page. If the changes are material, we will make reasonable efforts to tell you, for example in the app. Using Tellbit after changes are posted means you accept the updated terms.

Governing law

These terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising from these terms or your use of the service is subject to the exclusive jurisdiction of the courts of the United Arab Emirates. If you are a consumer, this does not take away any mandatory consumer protection rights you have under the law of the country where you live.
